Specific Rules for Video & TV Advertisements

For all video advertisements published on social media platforms, television, websites, or other digital marketing channels, disclaimer text and promotional disclosures must be presented in a clear, legible, and prominent manner in accordance with applicable Australian Consumer Law (ACL) and Australian Competition and Consumer Commission (ACCC) advertising guidelines.

Disclaimer text must not be displayed briefly, obscured, excessively small, or otherwise presented in a way that may mislead consumers. Advertising disclosures must comply with the following prominence requirements:

1. Text Size

Disclaimer text must be sufficiently large and readable across the device or platform where the advertisement is viewed. Small or microscopic text that cannot reasonably be read by an ordinary consumer is not considered compliant.

2. Display Duration

Disclaimer text must remain visible on screen for a sufficient period of time to allow an ordinary viewer to read and understand the disclosure in full. Brief or rapidly disappearing disclaimers may be considered misleading.

3. Contrast & Visibility

Text must clearly contrast against the background video or imagery. Advertisers should use appropriate formatting such as:

- White text on dark backgrounds

- Dark text on light backgrounds

- Solid banners or overlays behind text where necessary

Disclosures must remain visually clear throughout the advertisement.

Advertising Disclosure Checklist

To assist with compliance under Australian Consumer Law (ACL), all advertisements, promotional materials, pricing campaigns, video ads, social media posts, and marketing content containing pricing or promotional offers should include the following disclosures where applicable:

Baseline Scope Disclosure

Any advertised price should clearly state that pricing applies to a “Standard Installation” only.

Inclusions & Exclusions

Advertisements should briefly define what constitutes a standard installation, including common assumptions such as:

- Single-storey property

- Single-phase electrical supply

- Standard meter box distance/access

- Typical installation conditions

Additional works, upgrades, non-standard installations, or site-specific requirements may incur additional costs.

GST Disclosure

All advertised retail pricing intended for Australian consumers should clearly indicate that GST is included unless otherwise expressly stated.
